Terms of Service

These Terms govern your use of the Gater platform. By signing in or sitting an exam, you agree to these Terms.

1. Accounts

You are responsible for keeping your credentials confidential. Sharing accounts or impersonating another candidate is prohibited and grounds for disqualification.

2. Acceptable use

• Do not attempt to circumvent proctoring (virtual cameras, screen mirroring, secondary devices not paired through the system).
• Do not capture, redistribute, or publish exam content.
• Do not interfere with the platform's operation, attempt to breach security, or scrape data.

3. Institution agreements

If you are an institution, your use of Gater is also governed by the order form and Data Processing Agreement signed between us. Where those documents conflict with these Terms, the order form prevails.

4. Fees

Per-candidate fees are billed to the institution unless the institution has configured candidate-paid exams. Refund policies are set by the institution.

5. Availability

We target 99.9% monthly uptime excluding scheduled maintenance. Specific service levels for enterprise deployments are defined in the SLA addendum.

6. Liability

To the maximum extent permitted by law, Gater is not liable for indirect, incidental, or consequential damages. Total liability is capped at the fees paid in the prior 12 months.

7. Termination

Either party may terminate for material breach with 30 days' written notice and an opportunity to cure. Upon termination we will return or delete personal data in line with the DPA.

8. Governing law

These Terms are governed by the laws of the Czech Republic. Disputes are subject to the courts of Prague unless an order form specifies otherwise.
